Newbury OUI

Newbury, Massachusetts is an Essex County town south of the Merrimack River. Newbury is bordered by Newburyport, West Newbury, Groveland, Georgetown, and Rowley. “Operating” a vehicle does not even require that the engine be running. The act of moving the gears is considered “operating” as is starting the engine. If one possesses keys a vehicle and the engine is warm, or if one is sleeping in a car, it is still possible to be convicted of “operating” under the influence.

“Under the Influence”

“Under the influence” is not synonymous with “intoxicated.” One does not have to be drunk to be driving under the influence of alcohol, and the prosecutor does not have to prove that a defendant was drunk.
