Negligent Operation of a Motor Vehicle Charges Against Truck Driver Diverted Prior to Arraignment
In November of last year our client, a commercial truck driver, was completing a string of overnight drives. He was heading to Maine with a cargo that he initially picked up on the west coast. Around 3:30 in the morning, while driving on a major interstate in Massachusetts, our client fell asleep behind the wheel of the truck. Police were dispatched to the scene and found our client sitting in the front seat of the truck unharmed. The truck however ended up deep into a wooded area. Our client was ultimately charged with negligent operation of a motor vehicle in violation of G.L. c. 90 section 24. Were he to be arraigned on this case he would have become unemployable as a commercial driver. Our office was hired. Today, we were able to convince the district attorney’s not to arraign our client. Instead, the case was diverted for three months to allow him to complete a driver’s safety course. Once the program is completed the case will be dismissed, again, prior to arraignment.
