It is important to remember that you have the right to refuse a breathalyzer test. If you do so, then your license will be suspended for 180 days for a first offense. If you take the test and fail (by blowing a .08 or higher), then your license will be suspended for 30 days.

OUI penalties in Massachusetts are very severe and can include jail time, loss of license, alcohol education or treatment programs, large fines and court fees, and car insurance increases. Drunk driving penalties are governed by Massachusetts General Laws Chapter 90 Section 24 and 24D. The punishments grow more severe with each subsequent offense.
